After blood began welling on the surface of her brain, Maribeth Chase underwent an operation by neurosurgeon Robert Tenny. She never recovered. Chase’s daughter, Claire Chase of Lenexa, holds a portrait of her.

Maribeth Chase didn’t know that the neurosurgeon who would be operating on her had been sued at least 16 times for allegedly making medical mistakes.



She didn’t know that former patients and their families contended in court records that he had botched treatments that left one patient dead, several more with paralysis and still others in need of remedial operations.

Or that a dozen years before, federal records show, a health care organization had denied him clinical privileges over concerns about the quality of his care.

Lawyer Argues $1M Is Standard for Malpractice Causing Stillbirth - ABA Journal



In February, A New York appeals court upheld a $1 million award for pain and suffering to Lucia Ferreira, who lost her baby during labor at home. She had previously complained of abdominal pain during three visits to Wyckoff Heights Medical Center, but was sent home with a painkiller, the New York Times reports.

Now a lawyer in a different stillbirth malpractice case, Jeff Korek, is arguing the verdict set a $1 million standard that should be accepted in the Bronx, the story says. Korek represents Vivian Acevedo, who claims in a suit against Lincoln Medical and Mental Health Center that a delayed emergency Caesarean caused her child to be stillborn. The hospital offered $500,000, an amount she turned down.



The cases are among the first to move through the legal system after New York’s highest court ruled in 2004 that women can sue for emotional suffering due to malpractice that results in stillbirth.

As reported by the New York Post, an autistic patient died after being held in a wrongful restraint. Erik Stanley, 37, a supervisor for disabled adults at a Staten Island mental health facility was charged with criminally negligent homicide.

According to the New York Post, a source said Stanley placed Henry in a "chokehold" and forced him onto his stomach. Stanley then got on top of the struggling patient as he was lying face down. This was considered "excessive force." New York Attorney Paul Walker Successfully Defends New York Licensed Physician - Benzinga



Peltz & Walker recently successfully defended a practicing physician during an investigation by the Office of Professional Medical Conduct (OPMC).

The medical malpractice defense attorneys at Peltz & Walker recently represented a New York State licensed physician during an inquiry by the Office of Professional Medical Conduct (OPMC). The matter came to the OPMC's attention when this doctor surrendered his medical license in another state during an investigation concerning his potential impairment while taking medications.



The physician then returned to New York to practice. During the OPMC's investigation it was discovered that during the last ten years, the physician had twice been arrested for assault. One incident had occurred ten years earlier and there was no record of the legal proceeding in question -- the small town was unable to locate the file on the case. Peltz & Walker's lawyers contacted the doctor's criminal defense lawyer and obtained a letter from him certifying that the prosecution abandoned the case.

The second event was much more recent. In this case, the physician and his criminal lawyer entered into an agreement with the prosecution that the doctor would enter a pre-trial program which would end with the dismissal of all charges if the doctor satisfactorily completed the requirements of the program. Peltz & Walker obtained documentation from the pre-trial program office stating that the doctor was in compliance. They also obtained a letter of explanation from the doctor's criminal attorney.

Schneiderman names public integrity officers statewide - Albany Times Union (blog)



Attorney General Eric Schneiderman has designated 14 current employees of his office to serve as “public integrity officers” around the state. Russ Haven of NYPIRG calls it “a major step forward in the fight to hold accountable those who defraud the taxpayers of this state.” The watchdogs mandate will be keeping an eye on local graft and official wrongdoing.

Colleen Glavin, a former ADA with Rensselaer County who now works in the AG’s Albany office, will have the thankless task of being what Schneiderman describes as the “cop on the beat” for local government corruption.



As part of his effort to crack down on corruption and restore the public’s trust in government, Attorney General Eric T. Schneiderman today announced the appointment of public integrity officers to serve in all of the Attorney General’s regional offices across the state. They will be charged with giving taxpayers a place to go to report complaints of government corruption without fear of local politics influencing the outcome.

Attorney General Schneiderman’s appointments reflect a renewed commitment of time and energy in the regional offices to public integrity matters, and will formally link them to the Attorney General’s central Public Integrity Bureau.
